RV Weather Enterprises, LLC a Delaware limited liability company, is the owner and operator of this website (“We,” “Us,” “Our”) and grants you access to and permission to use this website and all content and information contained on the website, (collectively, our “Site”), to obtain travel planning, route optimization, and weather-related risk assessment services solely for ground transportation purposes in the United States, Canada and Mexico (the “Services”), subject to these terms and conditions of use (these “Terms of Use”). Please read carefully.

Direct competitors of RV Weather Enterprises, LLC, meaning any person or entity that offers products or services in the fields of surface transportation travel planning or route optimization, may not access or use the Site or the Services except with prior written consent from RV Weather Enterprises, LLC.

Accessing the Website and Using the Services. By accessing our Site and using our Services, you agree to be bound by these Terms of Use. The Site is available only to individuals aged 18 and older. You represent that you are at least 18 years of age and have the capacity to create a binding legal obligation regarding your use of the Site. If you are unable or unwilling to abide by these Terms of Use, please immediately stop accessing our Site and using our Services. We may revoke your access to our Site and ability to use the Services at any time for any or no reason, including, without limitation, your violation of these Terms of Use. In addition, We may change, suspend, or discontinue our Site and/or the Services at any time.
Weather Warnings. We are not responsible for, and make no effort to provide, real-time notice or warnings of severe weather or short-lived, intense weather phenomena. Many people use services such as NOAA weather radio to maintain their awareness of potentially severe and dangerous storms.
Weather. We do not guarantee that any weather we reference will occur or has occurred, and we are not liable for any claims, damages, or purported liability arising from or related to any error, omission, or inaccuracy in weather, travel, or route optimization information.
Travel Conditions, Access to Communications, and Assumption of Risk. If you subscribe to our routing services, we may provide you with routing suggestions, but you must use your own judgment to determine your route and time of travel. Actual travel conditions may be different from predicted conditions. We are not responsible for your travel safety. You are responsible for the consequences of your actions and decisions. We are not responsible for maintaining communications with you or for communication outages for any reason. You assume all risks when you use our Services.
Registration. We require registration to access certain sections of our Site. Where applicable, you may register, create, and maintain an account (a “Registered User”) to use our Services. By creating an account, you represent and warrant that you have legal authority to enter into these Terms of Use. If and when you register with our Site, you agree to provide accurate and complete registration information. You also agree to notify Us of any changes promptly. Do not allow anyone else to access registered sections of our Site under your Registered User name. Do not share your password with another party. Do not share or redistribute information we provide you solely as a Registered User.
Consent to receive email. If you register as a Registered User, you consent to receive text messages (carrier charges may apply) emails, periodic newsletters, and other types of email communications from Us. You may choose to opt-out of certain newsletter and announcement email correspondence. Our Privacy Policy governs our use of your personally identifiable information.
Caravans/Group Rates. We understand that RV’ers often caravan. If you would like to use Our Services for your group or Caravan, please contact Us to learn about group rates.
Payment. You are responsible for promptly paying Us for any fee-based Services. At our discretion, your access to Services will be suspended unless and until we receive payment in full.
Intellectual Property. Copyright, trademark, and other proprietary rights and laws protect our Site and its intellectual property. No part of our materials on our Site (collectively, the “Content”), including, but not limited to, graphics, photographs, logos, or text, may be copied, photocopied, reproduced, translated, or reduced to any electronic medium or machine-readable form, in whole or in part, without specific written permission from the respective rights holder. Except as expressly provided, nothing contained in these Terms of Use shall be construed to confer on you or any third party any license or right, by implication or under any law, rule or regulation, including, without limitation, those related to copyright, trademark, or other intellectual property rights. We do not claim proprietary rights in public domain data depicted on the Site. We claim proprietary rights in the way we manipulate and display some public domain data.
Methodology. The Site and the Services provide and display information generated by a proprietary system that is and shall exclusively remain Our intellectual property (the “Methodology.”) You shall not use the Methodology aside from using the Site and/or the Services as permitted by these Terms of Use.
Permitted Uses. You may use the Site and the Services solely for your own personal (including members of your household), non-commercial use.
Prohibited Uses. You are solely responsible for all of your activity in connection with the Services and accessing our Site. Any fraudulent, abusive, illegal, or otherwise inappropriate activities are grounds for termination of your right to Services and to access our Site. 7. using any information derived from our Content or our Methodology to provide, offer to provide, or attempt to provide travel planning, route optimization, or weather-related risk assessment services for ground transportation purposes;
8. scraping, crawling, or using any other automated device or manual process to harvest data from our Site; and
9. using information obtained from our Site to solicit our customers or contributors to our Site.
Third-Party Content and Links. Our Site may contain links to third-party websites and service providers (e.g., National Weather Service, Instagram, Facebook, YouTube, etc.), which have separate and independent content and terms of use. Third-party websites and providers are not under our control. We are not responsible for and assume no liability for any statements, representations, or any other form of information contained in third-party content appearing on or made available through our Site, the Services, or both. We do not endorse third-party content by including it on our Site. We will not be liable, under any circumstances, for the illegality, inaccuracy, or error in any third-party content and your use of third-party websites. Access these sites and providers at your own risk.

Limitation of Liability. TO THE EXTENT THE FOREGOING LIMITATION OF LIABILITY IS PROHIBITED BY LAW, OUR SOLE LIABILITY TO YOU FOR DAMAGES WILL BE LIMITED TO $100.00.
Remedies for Violations. We may seek all remedies available at law and in equity for your violation of these Terms of Use, our Privacy Policy, or both, including, without limitation, the right to block access from a particular Internet address to our Site and suspend the Services.

For this reason, We have the right, in addition to any other remedies available at law or in equity, to enjoin you from violating this Agreement without having to prove damages or post bond. These Terms of Use are binding upon and inure to the benefit of the parties hereto and their respective heirs, personal representatives, successors, and assigns.
